يجوز لقاضى التفليسة تعيين مراقب أو أكثر من بين الدائنين الذين يرشحون أنفسهم لذلك .
ويجوز للمفلس ولكل دائن الاعتراض على قرار قاضى التفليسة الخاص بتعيين المراقب دون أن يترتب على الاعتراض وقف تنفيذ القرار ، ويقدم الاعتراض إلى قاضى التفليسة نفسه ، ويجب أن يفصل فيه على وجه السرعة .
