يكون للأزهر شخصية معنوية عربية الجنس ويكون له الأهلية الكاملة للمقاضاة وقبول التبرعات التى ترد إليه عن طريق الوقف والوصايا والهبات بشرط ألا تتعارض مع الغرض الذى يقوم عليه الأزهر.
وشيخ الأزهر هو الذى يمثل الأزهر، ويكون له حق مقاضاة نظار الأوقاف التى للمدرسين أو الموظفين أو الطلاب نصيب فيها، وذلك دون إخلال بما لوزارة الأوقاف من الحقوق والاختصاصات المقررة فى اللوائح والقوانين.
