فى الأحوال المنصوص عليها فى المواد الثلاث السابقة تكون عقوبة الحبس من ثلاث سنوات إلى سبع إذا كان من وقعت عليه الجريمة لم يتم من العمر ست عشرة سنة ميلادية أو إذا كان الجانى من أصول المجنى عليه أو من المتولين تربيته أو ملاحظته أو ممن لهم سلطة عليه أو كان خادما بالأجر عنده أو عند من تقدم ذكرهم .
